1. Information We Collect

Market Minter collects information you provide when creating an account, including your name, email address, business information, and payment details. We also collect usage data such as pages visited, features used, and content generated through our platform.

For SMS recipients (separate from platform users), we collect phone numbers obtained through one of the following: (a) opt-in forms on our website or partner sites where you provided your phone number and consented to receive SMS from us, (b) inbound SMS conversations where you texted us first, (c) appointment booking systems where you provided your phone number for scheduling, or (d) your subscription to Market Minter services. We also retain message content sent and received, opt-out requests, and timestamps of all SMS interactions.

2. How We Use Your Information

We use your information to:

  • Provide, maintain, and improve our services
  • Generate AI-powered marketing content on your behalf
  • Process payments and manage your subscription
  • Send service-related communications
  • Analyze usage patterns to improve our product
  • Send SMS communications you have opted in to receive

3. Third-Party Processors

We use the following third-party services to operate Market Minter:

  • Supabase — Database and authentication
  • Anthropic — AI content generation and analysis
  • Twilio — Phone, SMS, and WhatsApp communications
  • Stripe — Payment processing
  • ElevenLabs — Voice synthesis
  • Vercel — Hosting and deployment
  • Sentry — Error monitoring
  • PostHog — Product analytics (with consent)
  • Resend — Email delivery
  • Apollo.io — B2B contact data

We do not sell or share personal information with third parties for marketing purposes. Our third-party processors are bound by data processing agreements that restrict use of data to providing services to Market Minter. SMS recipient phone numbers are never sold, rented, or transferred to any third party, and SMS opt-in consent is not transferred between affiliates or other parties.

4. Data Retention

We retain your account data for as long as your account is active. Upon account deletion, we remove your personal data within 30 days. Some anonymized usage data may be retained for analytics purposes.

For SMS, we retain consent records, send logs, and opt-out records for a minimum of four years as required by FCC regulations and for compliance defense purposes. Phone numbers added to our Do Not Contact list are retained permanently to ensure we never re-contact someone who opted out.

5. Your Rights

You have the right to:

  • Access your personal data
  • Correct inaccurate data
  • Delete your account and associated data
  • Export your data in a portable format
  • Opt out of non-essential cookies and analytics
  • Opt out of SMS communications at any time by replying STOP, UNSUBSCRIBE, CANCEL, END, QUIT, OPTOUT, or REVOKE to any message we send

6. GDPR / CCPA

If you are in the EU/EEA, you have additional rights under GDPR including the right to data portability, the right to restrict processing, and the right to lodge a complaint with a supervisory authority.

If you are a California resident, you have rights under the CCPA including the right to know what personal information is collected, the right to delete your data, and the right to opt out of the sale of personal information. We do not sell personal information.

7. Cookies

We use essential cookies for authentication and session management. Analytics cookies (PostHog) are only loaded with your consent.

8. SMS and Mobile Messaging

When Market Minter sends SMS messages, we collect and process the following data:

  • Recipient phone numbers obtained through opt-in forms, inbound conversations, appointment booking, or customer subscriptions
  • Recipient business name and contact information when provided as part of the consent flow
  • Message content sent and replies received
  • Opt-out requests and timestamps
  • Compliance evidence including consent timestamp, source, IP address (for form-based consent), and scope of authorized communications

We do not:

  • Sell phone numbers or contact information to third parties
  • Share recipient data with third parties for marketing purposes
  • Use recipient data for any purpose other than the specific scope authorized in your consent
  • Transfer consent between affiliates or other parties
  • Send SMS to recipients who have not provided express consent

We send SMS only within the scope authorized at the time of consent. For example, if you opted in to receive appointment reminders, we will not send you marketing messages. If you became a Market Minter customer, you may receive account notifications and support replies, but not marketing of unrelated products.

Recipients can opt out of all SMS communications at any time by replying STOP, UNSUBSCRIBE, CANCEL, END, QUIT, OPTOUT, REVOKE, or STOPALL to any message. Opt-out requests are honored immediately and permanently across our entire system. Message and data rates may apply.

SMS frequency varies by communication type. Account and support messages are sent as needed. Marketing follow-up messages (where you opted in to receive them) are limited to no more than two per week. We send SMS only between 9:00 AM and 7:00 PM recipient local time, on weekdays only.
